Others, however, argue that the circumstances of individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment. Fixing punishments for each type of crime has been a debatable issue. There are many arguments supporting both views, those for and those against fixed punishments.
This
essay will analyze both sides of the argument,

, I am personally inclined to the latter view that suggests considering the circumstances of crime

sentencing someone. First of all, fixed punishments will have a deterrent effect on society.
This
is because once damage has been endured by society, a corresponding consequence must occur. Once consequences take in virtue of simplicity, and people become easily aware of how they will be punished, there is a likelihood that criminals will reconsider committing
this
act in the first place. Thanks to
this
deterring effect is leading to social stability and security, through minimizing the number of crimes committed. If people knew that they would be able to convince the court or the jury of the reason they did, penal decisions would be largely arbitrary.
This
would result in criminals getting away with their crimes and into treated unequally caused by the subjective approach of different courts.

, taking the situation of a crime and its motivation into consideration is a prerequisite for establishing and ensuring justice and equity.A person killing in self-defence cannot be compared to a serial killer, moving from one victim to the next.
